CSMS # 67844987 - Imposing Temporary Section 122 Duties
As a follow-up to our prior communication regarding the termination of the IEEPA tariffs, we would like to inform you that U.S. Customs and Border Protection (CBP) has issued CSMS #67844987, concerning the imposition of a temporary additional 10% ad valorem duty under Section 122 of the Trade Act of 1974, see Executive Order Here. This surcharge applies to merchandise originating in any country, entered for consumption on or after 12:01 a.m. ET on February 24, 2026, and will remain in effect for 150 days (through 7/24/26), unless the merchandise qualifies for one of the specific exemptions set forth in Chapter 99 of the HTSUS (including in-transit cargo, USMCA-eligible goods, certain agricultural products, civil aircraft, donations, informational materials, among others). Until CBP issues further instructions, the duty will be applied strictly in accordance with current official guidance.
